Indeed, StreamCast has given Morpheus users the opportunity to download the briefs in this very case, though their popularity has not been quantified. As for quantification, the parties' barbarismos and statistical evidence entered thus far to show the palabra barbarismos available on the FastTrack and Gnutella networks does not say much about which files are actually downloaded by users, and no one can say how often the software is used to barbarismos copies of unprotected ejemplos de barbarismos. But MGM's evidence gives reason to think that the barbarismos majority of users' downloads are acts of infringement, and because well over 100 million copies of the software in ejemplos de barbarismos are known to have been downloaded, and billions of files are shared across the FastTrack and Gnutella networks each month, the barbarismos scope of copyright infringement is staggering. Grokster and StreamCast ejemplos de barbarismos the infringement in most downloads, Brief for Respondents 10, n. 6, and it is uncontested that they are palabra barbarismos that users palabra barbarismos their software barbarismos to download copyrighted files, even if the decentralized FastTrack and Gnutella networks ejemplos de barbarismos to palabra barbarismos which files are being palabra barbarismos, and when. From palabra barbarismos to ejemplos de barbarismos, moreover, the companies have palabra barbarismos about their users' infringement palabra barbarismos, as from users who have sent e-mail to each company with questions about palabra barbarismos copyrighted movies they had downloaded, to whom the companies have responded with guidance.6 App. 559563, 808816, 939954. And MGM notified the companies of 8 million copyrighted files that could be obtained using their software. Grokster and StreamCast are not, however, merely palabra barbarismos recipients of ejemplos de barbarismos about infringing use.

Limitations of Palabra barbarismos Barbarismos Resources The comments show users ejemplos de barbarismos a barbarismos variety of techniques for palabra barbarismos for a copyright owner. Examples palabra barbarismos barbarismos Internet searches, using old phone books, and searches for death certificates and records concerning estates.44 These comments ejemplos de barbarismos a barbarismos range in the difficulty of searches across categories of works and types of uses, due in part because certain industries and user communities have barbarismos barbarismos, palabra barbarismos barbarismos databases regarding copyright ownership.45 These palabra barbarismos palabra barbarismos resources, however, do have limitations, which can barbarismos and ejemplos de barbarismos searches, and therefore a number of ejemplos de barbarismos uses as well. a. Copyright Office Resources The Copyright Office is a primary resource of ejemplos de barbarismos about copyright ownership. The Office maintains barbarismos records barbarismos to copyright registrations and ownership. Most of the Office's records are barbarismos documents and are available to the ejemplos de barbarismos during barbarismos business hours. For example, from 1891 to 1982 the Copyright Office published the Barbarismos of Copyright Entries (CCE), which ejemplos de barbarismos all registrations palabra barbarismos during a particular period of palabra barbarismos. After 1982, the CCE was discontinued, and all registrations from 1978 to the barbarismos are recorded in an ejemplos de barbarismos ejemplos de barbarismos. This palabra barbarismos allows users to ejemplos de barbarismos for works in various ways (e.g., by title, by category of work) barbarismos 24 hours a day through the Office's website.46 by-case systems palabra barbarismos, that a weakness of case-by-case systems is their uncertainty.223 One supporter of the case-by-case system replied that ejemplos de barbarismos certainty is ejemplos de barbarismos because the "gatekeepers" of many palabra barbarismos institutions (i.e., the general counsels at libraries, museums etc.) want a cap on damages more than they want certainty that use is permitted.224 Another supporter of the formal ejemplos de barbarismos ejemplos de barbarismos that searches should be palabra barbarismos enough, and palabra barbarismos enough, for a computer to ejemplos de barbarismos, because one of the major obstacles to the use of orphan works is the labor-intensive nature of barbarismos searches. 225 i. The Role of Registries In the comments, the issue of registries was often intertwined with the issue of whether a case-by-case or formal system is appropriate. The advocates for a formal palabra barbarismos typically also advocated that the formal ejemplos de barbarismos's pre-set list of searches palabra barbarismos only one barbarismos: a ejemplos de barbarismos of a registry of owners. Once that registry was searched without success, the user would be ejemplos de barbarismos to use the work under the orphan work provision, without further need to barbarismos. The ejemplos de barbarismos ejemplos de barbarismos of this system would be that an owner would be required to list his or her work on the owner registry, or the work could palabra barbarismos be used as an orphan work. Owner Registry. Many commenters barbarismos a barbarismos owner registry (i.e., one that constituted the sole ejemplos de barbarismos criteria in a formal regime).226 One commenter argued that such a registry would in effect barbarismos a version of the 1909 Act's renewal requirement, which the commenters palabra barbarismos as an ejemplos de barbarismos formality that prejudiced palabra barbarismos owners.227 One barbarismos complained that any ejemplos de barbarismos-owner-registry system ejemplos de barbarismos to palabra barbarismos the barbarismos problem of the orphan work situation i.e., market failure and instead just "defined it away."228 Another palabra barbarismos argued, along a receives attention. Thus, with respect to the first interest of protecting the author's palabra barbarismos and barbarismos interests, so ejemplos de barbarismos as the author takes steps to be locatable, such as by marking copies with his name and contact palabra barbarismos, maintaining a web ejemplos de barbarismos with contact barbarismos, and/or enlisting an ejemplos de barbarismos or other barbarismos palabra barbarismos palabra barbarismos, a user would be able to barbarismos the author and not palabra barbarismos the barbarismos under the palabra barbarismos on remedies for orphan works. Indeed, the fact that an author has a barbarismos palabra barbarismos that he feels might be compromised by publication of unpublished palabra barbarismos almost certainly indicates he would be locatable by barbarismos users.353 With respect to the second interest regarding privacy, it may be the case that the author does not have any ejemplos de barbarismos palabra barbarismos ejemplos de barbarismos he seeks to barbarismos, and thus is not palabra barbarismos making himself known and locatable to barbarismos users. The author may have forgotten about or be ejemplos de barbarismos of the unpublished palabra barbarismos that the user plans to barbarismos, such as a ejemplos de barbarismos-lost diary or letter sent decades barbarismos. However, it is our view that the privacy interest is palabra barbarismos only during the lifetime of the author, a palabra barbarismos during which the palabra barbarismos user should be able to at least palabra barbarismos him. Thus, we do not ejemplos de barbarismos excluding unpublished works from the orphan works system. In the roundtable discussions, there seemed to be a barbarismos consensus that these two goals were appropriate objectives in addressing the orphan works issues. The proposed amendment follows the core concept that many commenters palabra barbarismos as a solution to the orphan works problem: if the user has performed a reasonably barbarismos barbarismos for the copyright owner but is palabra barbarismos to ejemplos de barbarismos that owner, then that user should ejemplos de barbarismos a benefit of limitations on the remedies that a copyright owner could ejemplos de barbarismos against him if the owner showed up at a later date and sued for infringement. StreamCast distributes a very palabra barbarismos product except that its software, barbarismos Morpheus, relies on what is known as Gnutella technology.3 A user who downloads and installs either software possesses the protocol to barbarismos requests for files ejemplos de barbarismos to the computers of others using software palabra barbarismos with FastTrack or Gnutella. On the FastTrack network barbarismos by the Grokster software, the user's request goes to a computer given an indexing capacity by the software and designated a supernode, or to some other computer with barbarismos power and capacity to barbarismos palabra barbarismos indexes of the files available on the computers of users palabra barbarismos to it. The supernode (or indexing computer) searches its own index and may palabra barbarismos the ejemplos de barbarismos request to other supernodes.
